Open Meeting Law not Violated over Mediation

KP Law’s Jonathan Silverstein has obtained a ruling on behalf of the Town of Westford, rejecting a claim that the Town’s Board of Selectmen and Planning Board violated the Open Meeting Law in connection with executive sessions they held to consider whether to participate in mediation and whether to approve the resulting settlement. The ruling is important to ensure that the Open Meeting Law will not be interpreted in a manner that puts municipal boards and other governmental entities at a disadvantage relative to private litigants.
