Attorney Jeffrey T. Blake successfully defended the City of Amesbury in a taxpayer’s suit in land Court seeking to recover more than $230,000 in alleged wrongfully assessed real property taxes. Amesburyport Corp. sought a refund of approximately $230,000 in taxes already paid on the Hatter Point Condominiums. With interest, this claim could have amounted to in excess of $400,000. Now that the appeal period from the decision of the Land Court has expired, the Land Court decision has become final. The City prevailed in its argument that Amesburyport Corp. was properly assessed the tax, and that the corporation’s failure to have timely filed an appeal of the assessment could not be circumvented by suing for a declaration of tax liability.
