We are pleased to announce that Attorneys Deborah I. Ecker and Gregg J. Corbo have been selected by Massachusetts Lawyer’s Weekly as “2024 Lawyers of the Year” for their representation of the Town of Middleborough School Department with respect to enforcement of the School District’s dress code. The plaintiff, a seventh grader, filed in the Federal District Court for Massachusetts a Complaint and Emergency Motion for a Temporary Restraining Order and Motion for Preliminary Injunction after the School District told him to remove a t-shirt with imagery that it concluded violated the dress code policy prohibiting targeting “groups based on race, ethnicity, gender, sexual orientation, gender identity, religious affiliation or any other classification.” Procedurally, the Federal District Court, and later the First Circuit Court of Appeals, found in favor of the Town, concluding that the plaintiff could not succeed on the merits of his argument. Following the June, 9, 2024 First Circuit Court of Appeals decision, the plaintiff has sought further review in the United States Supreme Court, where the matter is being handled on a pro bono basis by a firm that frequently appears before the United State Supreme Court.
