Attorney Katharine Klein works primarily with cities and towns on their real estate needs, bringing to her practice nearly fifteen years of experience with the particularized laws that govern these transactions. Attorney Klein represents municipalities in acquisitions, dispositions and leasing of properties, eminent domain proceedings and procurement issues and advises on the protection of land, including conservation and historic preservation restrictions and on the creation of affordable housing. She drafts purchase and sale agreements, requests for proposals, warrant articles, leases, land development agreements, easements, restrictions and covenants. Her practice also includes advising cities and towns on general municipal law, including town meeting, municipal finance, public records and open meeting law. She works closely with cities and towns to implement their objectives, in a reasonable, efficient and timely manner.
Prior to joining the firm, Attorney Klein practiced with private law firms in New Hampshire, where she represented governmental bodies, lenders and developers in a broad range of matters.
- Represented multiple cities and towns, including Amesbury, Braintree, Swampscott, Montague and Truro in the negotiation of agreements for the creation of residential and commercial developments, including drafting and negotiation of purchase and sale agreements, land development agreements, licenses, easements and other documents to effectuate the transactions.
- Represented the Town of Weston in the creation of two affordable housing developments.
- Represented the Groton Housing Authority in the acquisition of 9 affordable housing rental units, financed by the Massachusetts Partnership Fund Board and the Department of Housing and Community Development.
- Represented the Town of Watertown in connection with its HOME program, and other affordable housing related matters.
- Represented the Town of Westford Affordable Housing Trust in financing several affordable housing communities.
- Represented the Town of Wayland Affordable Housing Trust in the acquisition of property for the creation of affordable residential units.
- Assisted municipalities working with the Massachusetts Department of Transportation on road, bridge and rail-trail projects, including the Towns of Brookline (special counsel), Natick (special counsel), Amesbury, Ayer, Georgetown, Hubbardston, Lanesborough, Lenox, Great Barrington, Southampton and Worthington.
- Advised multiple towns, including the Towns of Ashby, Boxford, Westford, Dalton, Lenox, Westford, Weston, Seekonk and Southampton, among others, in acquiring and permanently preserving land for open space, recreation, and watershed protection purposes, including analysis of Article 97 issues related to the transactions.
- Represented the Towns of North Brookfield and Royalston, among others, in leasing land for the installation and operation of solar voltaic systems.
- Assisted municipalities in selling and developing properties in partnership with the Department of Capital Asset Management and Maintenance.
- General municipal law services as primary contact attorney for towns. Responsible to Boards of Selectmen and Town Administrators and Town Managers for providing efficient and cost effective Town Counsel services.
